Rights of a dying person

The rights of the dying person should be an integral part of the overall rights of the patient. It is important to recognise that these are norms linked to the end of a person's existence, and as such should receive special attention from those providing medical or nursing care. Patients' rights are a relatively new field if we consider the genesis of the development of human rights. However, in a democratic state under the rule of law, it seems to be a necessity to respect them. Therefore, the national legislator, following international trends in the protection of human rights, undertook to regulate the rights of the dying person in the Act on Patients' Rights and the Patients' Ombudsman. This article is a discussion of the human rights of the dying and the conditioning of this protection in both international and domestic law. The article has been prepared on the basis of the literature on the subject and the applicable legislation.
