Sociology of patient rights - selected observations, analyses and reflections

The legal situation of the patient has become one of the most important elements in the health care debate. It is linked to a specific situation. The patient is forced to give intimate details of his or her life when meeting with a medical expert. Patients' rights are most often analysed in legal terms, referring to specific laws or regulations. However, it should be noted that these patients' rights 'reside' primarily in institutions such as hospitals or clinics. Moreover, they are not only part of the broader system of medical law. They relate to a specific encounter that takes place between a patient and a medical expert. How can the aforementioned relationship be applied to the concept of patient rights? Are there laws that specifically refer to interactions that take place between a doctor and a patient? Is the formal implementation of legislation sufficient to conclude that patient rights are fully respected? The proposed article attempts to answer these questions.
